Terms of Service

These Terms of Service (“Terms”) govern access to and use of websites, forms, digital content, and text-message programs operated by CareServ (“CareServ,” “we,” “us,” or “our”) that link to these Terms. By accessing or using a covered website or service, you agree to these Terms.
These Terms do not replace a separately signed master services agreement, statement of work, business associate agreement, order, or other contract governing paid or managed services. If a signed agreement conflicts with these Terms concerning those contracted services, the signed agreement controls.
1. Eligibility and Authority
You must be at least 18 years old and legally able to agree to these Terms. If you use the website or services on behalf of an organization, you represent that you are authorized to bind that organization.
2. Permitted Use
You may use our websites and forms for lawful business and informational purposes. You agree not to:
- Violate applicable law or the rights of others;
- Submit false, misleading, fraudulent, infringing, harmful, or unlawful content;
- Introduce malware, interfere with security, disrupt operations, or attempt unauthorized access;
- Scrape, harvest, probe, reverse engineer, or use automated means to access a service except as expressly permitted in writing;
- Impersonate another person or misrepresent your affiliation or authority; or
- Use the website or services to send spam, unlawful solicitations, or abusive communications.
We may restrict or suspend access where reasonably necessary to protect CareServ, customers, users, systems, or legal compliance.
3. Information Submitted Through Forms
You are responsible for the accuracy and lawfulness of information you submit. Submission of a form is a request for contact and does not create a customer relationship, guarantee acceptance of work, or modify an existing agreement. Do not submit sensitive personal, medical, financial, authentication, or resident information through a general website form unless CareServ specifically directs you to an approved secure channel.
4. SMS Program Terms
CareServ’s SMS program provides separate transactional and marketing text-message services. Transactional messages include appointment reminders, support updates, account alerts, and order or service-status updates. Marketing messages include product announcements, sales, discounts, special offers, events, and similar promotions.
Transactional messages
If you separately opt in to transactional messages, CareServ may send service-related texts such as appointment reminders, support updates, account alerts, and order or service-status updates to the telephone number you provide.
Marketing messages
If you separately opt in to marketing messages, you provide prior express written consent for CareServ to send promotional texts about products, services, sales, discounts, special offers, events, and similar marketing, including through automated technology where applicable. Marketing consent is optional and is not a condition of purchase, receiving services, or submitting a website form.

- Reply STOP to unsubscribe from the applicable text-message program.
- Reply HELP for help, email info@gocareserv.com, or call (678) 649-3000.
- You may also revoke consent by any other reasonable method that clearly communicates your request. CareServ will honor revocation and opt-out requests within the time required by applicable law.
- After an opt-out, CareServ may send one non-marketing message confirming the request.
- Consent applies only to CareServ and the message category selected. Transactional and marketing choices are maintained separately to the extent required by law and operationally feasible.
- Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
- Mobile information and text-message consent will not be sold, rented, or shared with unrelated third parties for their own marketing.
- Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier and network availability.
You represent that you are the subscriber or customary user of the mobile number provided, or are authorized to consent for that number. You agree to notify CareServ promptly if the number is reassigned, disconnected, or no longer under your control. CareServ may change the number or short code used for a program and will provide notice where required.

5. Email Communications
CareServ may send transactional or relationship email concerning requests, services, or accounts. Marketing email will include a clear way to unsubscribe as required by applicable law. An unsubscribe from marketing email may not stop service-related email that is necessary to administer an active relationship.
6. Intellectual Property
The websites and their content, design, text, graphics, logos, software, and other materials are owned by or licensed to CareServ and are protected by intellectual-property laws. Subject to these Terms, CareServ grants you a limited, revocable, nonexclusive, nontransferable right to access and use the website for its intended purpose. No other rights are granted.
“CareServ” and related names, marks, and logos are trademarks or service marks of CareServ or its licensors. You may not use them without prior written permission.
7. Feedback and Submissions
If you provide suggestions or feedback, you grant CareServ a nonexclusive, worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not grant CareServ ownership of your personal information, which is handled under the Privacy Policy.
8. Third-Party Services and Links
The website may include links, embeds, integrations, or services provided by third parties. CareServ does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. Your use of third-party services is governed by their terms.
9. Privacy and Security
Our Privacy Policy is incorporated into these Terms by reference. You are responsible for using reasonable security practices on your devices and accounts and for promptly reporting suspected unauthorized activity affecting a CareServ interaction.
10. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITES, FORMS, AND GENERAL DIGITAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CARESERV DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CARESERV DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR A PARTICULAR LEGAL, CLINICAL, TECHNICAL, OR BUSINESS PURPOSE.
Information on the website is general information and does not constitute legal, medical, accounting, or other professional advice. Contracted CareServ services remain subject to the warranties, service levels, and remedies in the applicable signed agreement.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARESERV AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM THE WEBSITE, GENERAL DIGITAL CONTENT, OR TEXT-MESSAGE PROGRAMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, CARESERV’S AGGREGATE LIABILITY ARISING FROM THE WEBSITE, GENERAL DIGITAL CONTENT, OR TEXT-MESSAGE PROGRAMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID CARESERV, IF ANY, SPECIFICALLY FOR THE AFFECTED WEBSITE OR DIGITAL SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply where prohibited by law and do not alter liability provisions in a separately signed agreement governing contracted services.
12. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless CareServ and its affiliates, officers, employees, and agents from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or content you submit that violates law or another person’s rights. This section does not require indemnification for CareServ’s own unlawful conduct and does not modify a separately signed agreement.
13. Compliance With Communications Laws
CareServ intends to administer covered communications in accordance with applicable requirements, including the Telephone Consumer Protection Act, FCC rules concerning calls and texts, federal and Georgia Do Not Call requirements, and the CAN-SPAM Act for commercial email. Users may not use a CareServ website or service to conduct communications that violate these requirements.
14. Changes to the Services or Terms
We may modify the website, discontinue features, or update these Terms. Updated Terms will be posted at this location with a revised effective date. Changes apply prospectively unless applicable law permits otherwise. We will not use an update to these Terms to retroactively create or expand text-message consent. If required by law, we will provide additional notice or obtain renewed consent.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles, and applicable federal law. Unless a separately signed agreement provides otherwise, any legal action concerning these Terms must be brought in a state or federal court with jurisdiction in or over Forsyth County, Georgia. You and CareServ consent to personal jurisdiction and venue in those courts.
Nothing in these Terms limits a non-waivable consumer right or remedy under applicable law.
16. Severability; Waiver; Assignment
If a provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without CareServ’s written consent. CareServ may assign these Terms in connection with a merger, reorganization, sale of assets, or by operation of law.
17. Entire Agreement
These Terms and the Privacy Policy are the entire agreement concerning the website, general digital content, and text-message programs covered here. They do not supersede separately signed agreements governing contracted services.
